Grievance redressal continues smoothly under the RERA Conciliation Forum

Noida: A project of “A. T. S. Allure three allottees”  Siddharth Jain,  Kshitij Khanna” and ”  Kishan Kumar Sarraf, while ensuring the implementation of the order passed by the bench, got the possession of their units along with interest for the delay in possession and the settlement of the dispute between the allottees and the promoter, which was going on for years. It was done with mutual consent.

In the hearing of the Conciliation Forum  all the three allottees demanded immediate possession of the unit along with the interest for the delay period. Both the parties gladly accepted and thus the dispute regarding possession and interest of delay was brought to an end.

In the case of Siddharth Jain (NCR144/09/81571/2021), a resident of Gautam Budh Nagar, the first allottee received around Rs.5 lakh as interest for delayed possession. Apart from this, it was decided by the allottee to get the possession of his unit by paying only TDS amount of 22 thousand 300, only 10 percent of the final demand amount. About Rs 37 lakh 84 thousand had been paid by the allottee in the year 2015 for the unit costing Rs 39 lakh 34 thousand.

Similarly, in the case of second allottee Delhi resident, Kshitij Khanna (NCR144/03/72100/2021), the promoter’s final demand amount of about Rs.5 lakh 60 thousand was adjusted towards interest of about Rs.10 lakh for the delay in getting the possession. Thus the allottee received around Rs.4.50 lakh as interest for delayed possession. Apart from this, it was decided by the allottee to get the possession of his unit by paying only TDS amount of about Rs. 56 thousand. In the year 2014, the allottee had paid approximately Rs 32 lakh 20 thousand for the unit costing Rs 36 lakh 70 thousand.

In the case of the third allottee, Mumbai resident, Kishan Kumar Sarraf (NCR144/09/82761/2021), the promoter’s final demand amount of about 2 lakh 24 thousand was adjusted in the interest of delay in getting the possession of about Rs 8 lakh 32 thousand. Thus the allottee received about Rs. 5 lakh 46 thousand as interest for delay in possession.

Apart from this, it was decided by the allottee to get the possession of his unit by paying TDS amount of only about Rs. 22 thousand. About Rs 39 lakh 42 thousand had been paid by the allottee in the year 2015 for the unit costing Rs 40 lakh 93 thousand.

In more than 1100 cases, about Rs 483 crore has been settled in the RERA Conciliation Forum so far. Disputes related to assets have been resolved completely, in which most of them are related to accounts / calculations, non-delivery of possession.

Interest for the delay in possession is related to determination of parking space, meter fee, etc. Rare Committed to protect the interests of the allottees and is continuously hearing the complaints. Allottee & Promoter to amicably settle disputes between U.P. Conciliation Forum of RERA has been established.
